Introduction to The United Nations Universal Declaration of Human Rights

The foundation of human rights in the international and global arena has been a result of the negligence of mankind and benevolence among people to disgrace the ruthless acts in the world. The foremost salience in the development and foundation of human rights has been the aim to provide the human section with the freedom of speech, belief, choice, expression, etc. However, post a certain level, these human rights become dictatorial to people and mankind at the global range (Assembly, 2017).

For consideration, the freedom from torture or cruelty measures have also been seen to be brutal after a point. The study hence aims to investigate the accuracy in the permissibility of torture under specific circumstances in the frame of human rights.

Explanation of The United Nations Universal Declaration of Human Rights

As stated by Adams (2019), the ticking bomb scenario has become a speculative experimental idea about when it is justifiable to commit torture. Also, it has known the normal conditions where torture can be proven justifiable as it relates to the mistreatment and abuse of humans and its rights of livelihood in the world.

However, there has been a demanding justifiability towards knowing when the torture becomes justifiable in order to extract and know the ill-practices and terroristic moves in the place for the sake of maintenance of others’ human rights of the living.

Argument of The United Nations Universal Declaration of Human Rights

In my point of view, the provision of human rights has been entertained for the sake of the enjoyable and independent livelihood of humans. However, it does not incorporate the mislead and misconduct to be hosted with other human populations for personal beliefs and actions. Hence for the sake of maintaining and flourishing human survival, limiting the enjoyable levels of human rights is necessitated.

As stated in an incident by Aswani, (2017), an argumentative statement ‘the terrorist is forcing the police to choose between torturing the terrorist for knowing the malpractice acted or to allow the thousands of lives to lost’. Hence such cases and circumstances deduce the judgment of permissibility of torture.

Objection on The United Nations Universal Declaration of Human Rights

There has been an ongoing and ever-lasting argument of the permissibility and legality in the case of torture as a human right practice. There has been a list of people in favor of the permissibility whereas a bigger list of people who find torture as an objective criticism in human society.

As objected by Chan, (2019) in its studies, the torture as a crucial measure of interrogation as it abuses human rights by not only degrading the human rights but also the human rights to health. This way, it objects at one side of the human rights’ coin with that of the other rights to be enjoyed. 

Reply to Objection

Every situation and circumstance has to deal with certain advantageous and disadvantageous actions and claims. It is fundamental to say that torture for the sake of interrogation must be eliminated and replaced. Though the lesser of the two evils is still evil (Wiener, 2017), but there remains a gap in the interrogative processes in absence of torturous activities insulated.

As supported by Tiel, (2019), for the sake of procurement and extraction of relevant and truthful information from revolutionaries and the lethal attackers that put in danger the lives of innocents, the practice of torture must be justified and permissible.
