Generally, the work of a Registered Migrant Agent (RMA) means helping out clients that are moving to Australia. They provide immigration advice and assistance to the clients. A person opting to become an RMA must pose a legal practicing certificate and the Authorised body only has the power to issue a certificate for the same. They even help with the visa process. The law that regulates the work is the Migrations Agent Regulation of 1998[1] which is made under the Migration Act of 1958[2].

Business Objectives

Business Objectives are the goals that a company or an organisation wishes to fulfill in the future. Objectives define the framework of an organisation , and enables the smooth working of an organisation. The entire work of the organisation revolves around the objectives of a Business organisation . Part 2 clause 2.6 ,2.7 , 2.8 ,2,9 and 2.10 of the Migrant Agent Regulations Act of defines the objective criteria which should be followed up by an organisation.[3] So as per the Law states the objectives of my Migration agent business should be as follows:

  • To be clear and Precise when assisting a client who is making an application under the Migrations Act;
  • Must not have unjustified prospectus while giving advice to the client;
  • To act in accordance with the clients' instructions;
  • Not to make misleading or inaccurate statements;
  • Must not mislead or deceive the clients[4].

These are the main objectives which will be followed up by my organization .

Ownership and Management Structure:

Part 6 of the Act[5] stated that the structure and the work to be done by the management.

  • To keep copies of the client application;
  • To keep copies of the written documents between the client and the agent, client and the relevant Authority, 
  • When are documents will be delivered to the client they should be in accordance with the law
  • The agent will be keeping copies for 7 years after the date from the last action of the client that is seeking help fort the immigration.

Source of Customers and Marketing :-

Migrant officers working in Australia are governed by the Migration Agents Registration Authority (MARA). Teachers, doctors, engineers, and accountants have a great scope in Australia o, they are they will be the main customers. Because of the better living standards that Australia provides so the people can purchase a thing at a low cost. The students traveling to Australia act as an important source of customers for RMA business as Australian students are given visas easily and at a cheaper rate compared to other countries like UK and the USA.

Financial Requirements:-

Financial requirements are the monetary obligations that an organization needs to fulfill in order to have a smooth and proper working of the organization. Part 7 of the describes what are the financial requirements to be followed.

So, the requirements that I will be following up for my business will be:

  • The Expenses of the agents to be met;
  • Maintaining a clients account;
  • Maintaining different accounts of the client by their names;
  • The agent has to keep money in the clients account;
  • Maintaining adequate insurance and
  • The agent must have enough funds to meet the expenses that may arise in the future ;
  • Keeping copies of the client ledger which related to the clients’ money the details of the other documents that are related to the clients’ money.
  • Obligation to keep funds in clients account and maintaining proper insurance.

Business Risk:

  • Reduction in the number of student Visa Subclasses and the introduction of a simplified single immigration risk framework for all international students
  • Visa integrity
  • Demand for migration officers is comparatively low
  • Since most of the legal firms are also hiring people who are providing migration services, so the competition for the agents that are prevailing in the market is increasing.

 The companies which work with a proper strategy, offer job opportunities to highly skilled workers, having an advantage over their competitors.[6]

  • Increase in the level of RMA agents day by day .

Developing and Improving Your Skills and Knowledge:

As per the law, Section 1.10(vi) of the act states that the agent must have an adequate amount of knowledge of business to conduct as a migrant agent, including record keeping and file management[7].

Section 2.3 of the Act specifies that the agent must have sound knowledge of the Migration act and regulations and proper knowledge about the legislations that are related to migration procedure and capacity to provide accurate and timely advice to the customers.

Section 2.4 of the act states that agents must have due regard to the client’s dependence on the agent's knowledge and experience.

So as far the business is concerned the agent should have proper and sound knowledge of the Migrations Act 1958, the Migrations Regulations 1994, other legislations that are related to migration procedure and to maintain a proper library that includes material or the business in which he or she works and making sure that the person has the access to the library which is made by the organizations for the business to access.

Various types of classes and training programs can be conducted internally to enhance the knowledge of the Agents or employees can be sent to off-campus training programs in order to improve their skills and knowledge.
