Conflict of Interest

What action and communication would you use immediately with the client and your colleague. List 3 things you would do and say.

With client

The very first thing I would do is to protect her privacy (cover her up) which is a matter of great concern. I would calm her down and apologize for the rude behavior of my colleague. I will also tell her if she wants she can complain to the supervisor.

With colleague

The care worker was not complying with the principles of duty of care and legal responsibilities as the worker was rude with the resident, doors, and curtains were opened and privacy and dignity were not maintained. The worker was harassing her. I would immediately appropriately help the resident. In this case, I will report this matter to the supervisor in private (Srinivasulu, Dedipya & Mrudula, 2018).

What steps would you take to report any breach to standard procedures or event situation of concern to appropriate personnel

The steps are:

  • All types of clinical or cooperate incident must be reported verbally that too within 8 hours with a document submitted in written form within 24 hours
  • Each and every piece of clinical incidents of some significance is investigated in accordance with the review process associated with NSW's clinical health.
  • All types of recommendation based on the review process of endorsing risks management as a result of a relevant meeting
  • The mentioned type of recommendations is further reviewed, monitored as well as implemented that too, within 100days of incident’s notification.
  • The management is held responsible for providing an appropriate form of feedback in regards to the staff
  • The whole process of reporting must address the legal legislative requirements

In this case, I will not tell the care staff that I will not share what I have seen with others and will not make a promise. In the case of a situation associated with immoral behavior and abuse that must be reported compulsorily. I will report this matter to the supervisor privately. The organizational approach is to fill out an incident/accident form, take appropriate action, provide further training and education on abuse and care responsibilities, and assist everyone in maintaining respect (Dickens & Litsky, 2018).

List at least 2 ways you would demonstrate respect for the rights and responsibilities of others through the considered application of work practices.

The two ways are:

  • I will show respect by following the guidelines and trying to implement them in our work practice.
  • I can also demonstrate that via our communication. It’s all about if we have got awareness or not and also to what level we are motivated to consider and apply them.

For this scenario, the employee has rights:

  • To avail all resources for work
  • To avail training and education for professional development and to develop skill

The employee has responsibilities to:

  • Undertake the jobs nominated following duty of care, organization’s policies and procedures and being ethical at all times
  • Respect and deliver quality care along with safety and security
  • Follow instructions provided
  • Be available and considerate while communicating and supporting
  • Maintain privacy, confidentiality, and dignity for the residents

The employer has rights and responsibilities in the direction of providing as well as maintaining (Osman, 2016):

  • Ensuring safe work floors as well as access to a safe working environment
  • safe methods of working using manual handling systems with personal security procedures
  • Implementation of safe electrical equipment as well as cleaning products used to ensure a safe plant, with substantial use of labour-friendly types of equipment with facilities like toilets, hand sanitizing, drinking water.
  • To provide relevant instructional information, training as well as supervision ensuring safety with the implementation of an understandable language

  • PIP (Performance Increase Program) in the form of a warning letter can be assigned to an employee requesting him/her to fill up all the particulars and amends them.
  • As in the form of a long term working promise or reduce stability issues a bond or treaty can be signed off in between the employees and the employer's team HR.
